
Mediation
includes thoughtful analysis of the parties’ briefs, pre-mediation calls with counsel, the mediation session, as well as reasonable follow-up. Mediations are held via Zoom videoconference or in person, when safe.

Katherine is in the best position to provide her current availability for mediation, so please contact her directly.
Location
Mediations are generally held remotely. However, mediations may be held at counsel's office under appropriate circumstances including full agreement by Katherine, the parties, and counsel.
Fee
The per diem fee depends on a number of factors (e.g., the nature of the case, number of parties, including whether that matter is a single plaintiff or representative action). Case convening, including scheduling and logistics, is included in the fee. The fee also includes Katherine’s intensive preparation which involves careful and thoughtful reading and analysis of the parties’ briefs and individual pre-mediation conference calls with lead mediation counsel for each party, as well as the mediation day and reasonable post-mediation telephonic or email follow-up, as necessary.
Half-day mediations are offered on a limited basis. Fees for time spent after the mediation may be charged. She will consider these requests on a case by case basis. Fees for time spent after the mediation are charged at an hourly rate of $800. As stated above, reasonable follow-up is included in the per diem rate. If additional fees are incurred, a supplemental invoice will be provided which is due and payable upon receipt. The parties are responsible for any additional fees, pursuant to the agreement of the parties.
Cancellation Policy
The Cancellation Policy applies to counsel and parties upon counsel’s receipt of the original Notice of Mediation and Invoice. The mediation fee is fully refundable if the mediation is cancelled more than thirty (30) calendar days before the original mediation date if the Mediator has confirmed receipt of the request in writing. Otherwise, the mediation fee will not be refunded, regardless of the cancelling party or counsel. Cancellation requests must be confirmed in writing by the Mediator within the cancellation period to be eligible for a refund.
